MyGenie — Terms and Conditions of Use

These Terms are a binding agreement between you and Maximum Wellness (Pty) Ltd (registration 2020/672729/07), trading as MyGenie. By ticking acceptance when you register, you agree to these Terms. No handwritten or electronic signature is required.

References to "we", "us", "our" and "MyGenie" are to that entity. References to "you" and "your" are to the person using the Service. The Professional Site is at https://mygeniepro.financialconsult.co.za.
2. Definitions
Engine means the deterministic calculation library that produces MyGenie's financial projections.
Financial DNA means the structured record of your household's financial position that you build in the Service.
Professional means an independent third-party financial adviser, tax practitioner, attorney or other professional who is listed on, or who you connect with through, the Service.
Professional Site means the MyGenie Professionals application.
Service means the MyGenie consumer application and the Professional Site.
Vault means the document storage and sharing feature described in clause 10.
3. What MyGenie is — and what it is not
This clause is the most important one in this agreement. Please read it.
3.1 Illustrative and educational planning tool
The Service helps you model your financial position, project outcomes under stated assumptions, and understand how South African financial and tax rules work in general terms. It is educational and illustrative software.
3.2 MyGenie does not provide financial advice
Nothing in the Service constitutes "advice" as defined in section 1(1) of the Financial Advisory and Intermediary Services Act 37 of 2002 (FAIS). We do not:
- recommend that you buy, sell, retain or vary any financial product;
- recommend any particular provider, fund, policy or investment;
- provide intermediary services;
- provide legal, tax, accounting or estate-planning advice;
- provide a quotation for any financial product.
The Service is product-neutral. It describes categories of financial product and how rules work. It will not tell you what you should do.
3.3 We are not a Financial Services Provider
MyGenie is not an authorised Financial Services Provider under FAIS, is not a registered credit provider, and is not an authorised insurer or insurance intermediary.
3.4 You must obtain advice before acting
Projections are not a substitute for advice from a suitably licensed professional who has considered your full circumstances, read your actual policy documents and contracts, and accepted a duty toward you. You should not make any financial decision on the basis of the Service alone.
4. Eligibility
You may use the Service only if you are at least 18 years old and have legal capacity to contract. The Service is designed for people who are resident in, or have financial interests in, South Africa. Tax and regulatory logic is South African and will produce incorrect results if applied to another jurisdiction.
You may enter information about other members of your household, including dependants and children, only as inputs to your own financial modelling, and only where you are lawfully entitled to do so.
5. Your account
The Service uses passwordless authentication. You provide an email address and we send a one-time code. Entering that code creates a session on your device.
You are responsible for control of that email address and for all activity through your sessions. Notify us at support@financialconsult.co.za if you believe your account has been accessed without authority. Losing access to the email address may permanently prevent you from reaching the account.
6. Accuracy of your information
The Service computes outputs from the information you enter. It does not verify that information against any external source.
If your inputs are wrong, incomplete or out of date, the outputs will be wrong, even when a figure looks precise. You are responsible for accuracy and for keeping information current.
7. Calculations, assumptions and limitations
Every projection depends on an assumption set (inflation, growth, tax tables and similar). The assumption set in force is displayed alongside material figures. Changing an assumption changes the result.
Projections describe what would happen *if* the stated assumptions held exactly. They will not hold exactly. Past performance and modelled performance are not indicators of future results.
Tax outputs are illustrative calculations against published South African tax tables. They are not a SARS assessment or a tax opinion.
Figures may be rounded for display and must not be used for filing or contractual reconciliation. Where the Service cannot compute something, it will say so. Absence of a warning is not confirmation that a matter has been considered.
8. Product neutrality
The Service does not recommend, rank, endorse or receive consideration for directing you to any specific financial product, provider or fund.
9. Connecting with Professionals
Professionals listed on or reachable through the Service are independent third parties. They are not our employees, agents, partners or representatives. We do not supervise their work.
Any advice, recommendation, quotation, service or product provided by a Professional is under their own mandate, licence and terms. We accept no liability for it. Your recourse lies against the Professional and, where applicable, the FAIS Ombud or the relevant professional body.
We may display an FSP number or professional-body credential as supplied by that Professional. A "verified" mark in the Service is not a live check against the FSCA register. You should independently verify licence status before acting on advice or disclosing sensitive information.
Your Financial DNA and documents are not shared with any Professional unless you expressly consent to that sharing. Consent is recorded. Withdrawal cannot recall information already disclosed.
9.5 Booking links (including Cal.com)
A Professional may publish their own appointment link (including a Cal.com scheduling link they control). That booking is a contract between you and the Professional, and between the Professional and Cal.com (or the other booking provider). We do not operate that calendar, we are not a party to Cal.com's terms, and we are not responsible for appointments, cancellations, or personal information you give the booking provider.
10. The Vault and electronic signatures
You must not upload material you are not entitled to store or share.
Where the Service captures a signature on the built-in pad, you agree it is an electronic signature for the purposes of the Electronic Communications and Transactions Act 25 of 2002 (ECTA) and is intended to have the same effect as a handwritten signature. Certain documents (including a will under the Wills Act 7 of 1953) may still require a different form of signature in law.
10.3 Third-party signature services
A Professional may connect their own DocuSeal, DocuSign or other signing account, or paste an external signing link. That service processes the document under arrangements between the Professional and that provider. We are not a party to those terms. The Professional is responsible for that provider's POPIA and contractual duties. Starter and Practice use the built-in pad unless the Professional upgrades and supplies their own keys.
11. Fees and payment
Household use of the consumer Service is free of charge.
Professionals pay subscription fees in South African Rand through PayFast. We do not receive or store full card details. Refunds and cancellations follow PayFast's process and your rights under the Consumer Protection Act 68 of 2008 (CPA), including the section 16 cooling-off right where it applies to electronic transactions.
12. Acceptable use
You must not use the Service to provide financial advice to third parties unless you are properly licensed and using the Professional Site for that purpose; upload unlawful or malicious material; attempt unauthorised access; scrape listings; reverse-engineer the Engine except as the law allows; or misrepresent your identity or credentials.
13. Intellectual property
The Service, the Engine, the knowledge base and associated content are owned by us or our licensors. You receive a personal, non-exclusive, non-transferable, revocable licence to use the Service for its intended purpose. Information you enter remains yours. You grant us a licence to process it solely to operate the Service for you.
14. Availability and service status
The Service is provided as is and as available. We do not warrant uninterrupted or error-free operation.
Household models, chat and connections persist in PostgreSQL. Vault files live on the consumer volume; sealed letters live on the Professional volume. Scheduled volume backups are not yet enabled (they require a Railway Pro plan). A missing volume mount can still drop files on redeploy. We will give reasonable notice of material feature reductions where practicable.
15. Limitation of liability — no compensation for losses
This clause limits our liability. Please read it carefully. Ticking acceptance at registration is your specific agreement to this clause (CPA section 49).
To the maximum extent permitted by law, we are not liable and will not compensate you for:
- any financial decision you make, or do not make, in reliance on the Service;
- any difference between a projected outcome and an actual outcome;
- advice, services, products, bookings or signatures provided by any Professional or by Cal.com, DocuSeal, DocuSign or similar tools the Professional chooses;
- loss of profit, investment return, opportunity, or any indirect or consequential loss;
- loss or corruption of data, except to the extent caused by our failure to take reasonable security measures.
Where liability cannot lawfully be excluded, our aggregate liability is limited to the greater of the fees you paid us in the 12 months preceding the claim, or R1 000. Household users pay no fees, so that floor is R1 000 where a cap is still allowed.
Nothing in these Terms excludes liability for death or personal injury caused by negligence, for fraud, or for any liability that cannot lawfully be excluded — including CPA sections 60 and 61.
16. Indemnity
You indemnify us against claims arising from your breach of these Terms, your unlawful use of the Service, or your entering of another person's information without lawful basis.
17. Data protection
How we process personal information is described in the Privacy Notice and the Processors page. Those pages form part of these Terms.
We host the Service outside South Africa (EU West, Amsterdam, with operator support access from the United States). By accepting these Terms you consent to that cross-border transfer under POPIA section 72(1)(b), in addition to any other lawful ground we rely on.
18. Suspension and termination
We may suspend or terminate access if you materially breach these Terms or if the law requires it. You may stop using the Service and request deletion at support@financialconsult.co.za.
19. Changes
We may amend these Terms. Where an amendment materially affects your rights we will give reasonable notice by email or in the Service. Continuing to use the Service after the effective date constitutes acceptance. A new registration tick is recorded against the version shown at sign-up.
20. General
These Terms are governed by the law of the Republic of South Africa. The parties consent to the jurisdiction of the Magistrates' Court having jurisdiction, alternatively the High Court of South Africa, Western Cape Division. Nothing here limits a CPA right to refer a dispute to the National Consumer Commission or a consumer court.
If a provision is unenforceable, the remainder continues. These Terms are the whole agreement between us about the Service. Failure to enforce a provision is not a waiver.
